Terms and Conditions
1. General Provisions
1.1. The shop owner acting at www.designdevivre.pl is Katarzyna Czaplińska Interior Design, Tax ID: 118-089-11-35, REGON: 147081421, registered office: Kurowskiego 43, 05-080 Hornówek, e-mail: firstname.lastname@example.org
1.3.1. WORKING DAY – “Working days” must be understood as all weekdays (marked on the calendar in black) excluding Sundays and public holidays which, in accordance with Art. 1519 § 1 of the Labour Code are non-working days.
1.3.2. REGISTRATION FORM – the form available in the online shop that allows to create an account.
1.3.3. ORDER FORM - an electronic service, interactive form available in the online shop that allows placing an Order, in particular by adding Products to the electronic basket, and determines the conditions of the Sales Agreement, including the method of delivery and payment.
1.3.4. CLIENT / CUSTOMER - The customer is any natural person undertaking either a legal activity which is not directly related to their business or a professional activity, who places an order in the online shop.
1.3.5. CIVIL CODE – the Civil Code Act of 23 April 1964. (Journal of Laws No. 16, pos. 93, as amended).
1.3.6. USER ACCOUNT – an electronic service, the collection of resources in the ICT system of the Service Provider tagged with an individual name (login) and password given by the Customer, in which Customer’s data are collected including the information about placed Orders.
1.3.7. NEWSLETTER – an electronic distribution service provided by the Service Provider in the form of an e-mail, which allows all the Customers who use this service to automatically receive subsequent editions of the newsletter with information about the Products in the Online Shop.
1.3.8. PRODUCT / GOODS - movable property available in the Online Shop, which is the subject of the Sales Agreement between the Customer and the Seller.
1.3.9. REGULATIONS – the Regulations of the Online Shop as described herein
1.3.10. SHOP – the Online Shop of the Service Provider available at: www.designdevivre.pl
1.3.11. SELLER; SERVICE PROVIDER - Katarzyna Czaplińska who conducts business under the name Katarzyna Czaplińska Interior Design. The address of the place of business and mailing address: ul. Kurowskiego 43, 05-080 Hornówek, entered in the Central Register and Information on Economic Activity of the Republic of Poland operated by the minister responsible for economic affairs, Tax ID 118-089-11-35, REGON 147081421, e-mail: email@example.com.
1.3.12. SALES AGREEMENT – a sale agreement concerning a product, which is being drawn up or has been drawn up between the Customer and the Seller via the online shop.
1.3.13. ELECTRONIC SERVICE - a service provided electronically by the Service Provider to the Customer through the online shop.
1.3.14. RECIPIENT OF THE SERVICE - a natural person with full legal capacity, and in the cases provided for by the generally applicable rules also a natural person who has a limited legal capacity; a legal person or an organizational unit without legal personality, which is granted the legal capacity to use the Electronic Service by the law.
1.3.15. ORDER - the Customer's declaration of intent submitted in the Order Form and leading directly to the drawing up of the Product Sales Agreement with the Seller.
2. Rules of Using the Online Shop
2.1. Customer does not need to register or login to view the information on the shop website.
2.2. Registration and login are necessary if the Customer wants to make a purchase in the www.designdevivre.pl Online Shop.
2.3. Registration in the shop allows the Customer to use a variety of benefits:
No need to enter data for subsequent purchases;
View of the order status and the purchase history;
The ability to use the clipboard;
The ability to rate and add product reviews;
The ability to receive discounts and promotional coupons.
2.4. To register or login the Customer must click “Register” or “Login” button in the top right corner of the Online Shop website.
2.5. The successful completion of the registration process is possible provided all the required fields marked with an asterisk (*) in the registration form are filled in, and the Customer has accepted the Terms and Conditions of the DesignDeVivre Shop.
2.6. Customer’s email address serves as the login in the online shop
2.7. Katarzyna Czaplińska Interior Design may immediately deprive the Customer of their right to use the online shop, and may limit their access to some parts or all of the shop online resources in the event of their breach of the Terms and Conditions, in particular when the Customer:
a. while registering online shop gave untruthful, inaccurate or outdated data, which mislead or violate the rights of third parties,
b. exhibits other types of behaviour that may be considered by Katarzyna Czaplińska Interior Design as inconsistent with the applicable law or general principles of using the Internet, or as being detrimental to the good name of Design De Vivre.
2.8. A person who has been deprived of their right to use the online shop, cannot register again without the prior consent of Katarzyna Czaplińska Interior Design.
2.9. In order to ensure the safety of transmission of messages and data in connection with rendered services within the site, the Online Shop takes technical and organizational measures appropriate to the level of risk to ensure the safety of provided services, in particular it takes measures to prevent the acquisition and modification of personal data transmitted over the Internet by unauthorized persons.
2.10. The Customer is obliged in particular to:
a. use the Online Shop without disturbing its functioning, especially through the use of specific software or devices,
b. use the content published in the Online Shop only for personal use.
c. use the Online Shop in accordance with the law in force in the Republic of Poland, with the Terms and Conditions of the Online Shop, as well as with the general principles of using the Internet.
3. Product Prices and Payment Methods
3.1. Product prices listed on the www.designdevivre.pl Online Shop website are gross prices (they include VAT and any customs duties) and they are expressed in Polish zloty (PLN).
3.2. These prices do not include the cost of delivery and the cost of payment, which are indicated during the process of making an order
3.3. The product price shown on the www.designdevivre.pl Online Shop website is binding at the time of placing an order by the Customer. This price does not change regardless of changes in prices in the Online Shop which may arise in relation to individual products after the order has been made by the Customer.
3.4. The existing shop discounts and special offers cannot be combined.
3.5.The payment can be made by:

3.6. The settlement of transactions made by electronic payments or by credit card are carried out according to the Customer choice through the e-service. The processing of electronic payments is done by:

The share capital (invested capital) of the Company is: 4 500 000 PLN.
4. Placing Orders. Closing the Sales Agreement
4.1. Announcements, advertisements, price lists and other product information published on the DesignDeVivre Online Shop website, in particular their descriptions, technical and performance characteristics and prices, are an invitation to enter into an agreement within the meaning of Article 71 of the Civil Code.
4.2. The selection of Products ordered by the Customer is made by adding them to the basket.
4.3. When placing an order, until the Customer presses the “Order” button, they can modify the data and information about the ordered Goods. In order to this, the Customer should follow the prompts that appear on the website.
4.4. A summary of the order will be displayed after the Customer provides all the necessary data and will submit the following information:
the subject of the order;
the unit and total price of ordered products including the costs of delivery and other charges (if any)
the chosen method of payment;
the chosen method of delivery;
4.5. Before placing an order, the Customer is obliged to accept the Terms and Conditions of the www.designdevivre.pl Online Shop, enter their personal details marked with an asterisk (*) and press “Order”.
4.6. Placing an Order by the Customer is a declaration of intent to enter into a Sales Agreement regulated herein with the company Katarzyna Czaplińska Interior Design located in Kurowskiego 43, 05-080 Hornówek, holding the Tax Identification Number (NIP) 118-089-11-35 and REGON: 147081421, registered in the Central Register and Information on Economic Activity (CEIDG)
4.7. After placing an order on a form provided by the Shop website, the Customer will receive an email confirming their order made in the www.designdevivre.pl Online Shop. The email will contain all the essential information about the order and will be sent to an email address provided earlier by the Customer.
4.8. The Agreement shall be treated as concluded upon receiving by the Customer an email described above.
4.9. The execution of the contract shall be made following the payment for the Goods made by the Customer.
5.Termination of Agreement
5.1. The Customer who falls into the category of a consumer as defined in Art. 221 of the Civil Code, has the right to withdraw from an agreement concluded at a distance, without giving a reason.
5.2. The contract terminates when the Customer completes the form located in the “My Returns” tab within 14 days from the date on which the delivery of the Goods took place.
5.3. The Seller is required immediately, but no later than within 14 calendar days after having received the statement of the Customer willing to withdraw from the contract, to return to the Customer all payments made by the Customer including the cost of product delivery. The Seller shall refund the payment using the same method of payment which was used by the Customer while making a purchase in the www.designdevivre.pl Online Shop.
5.4. The right to withdraw from the contract by the Customer does not apply if:
a. the product is damaged or has been used during the 14 days from the date of delivery;
5.5. In case of the withdrawal from a contract concluded at a distance, the contract is considered null and void. What the parties rendered, shall be returned unchanged, unless a change was necessary in the ordinary course of business. The reimbursement should take place immediately, not later than within 14 days from the moment of delivery. 6. Complaints Regarding the Purchased Goods
6.1. Katarzyna Czaplińska Interior Design as a Seller is liable to any Customer who falls into a category of a consumer as described in Art. 221 of the Civil Code, for any discrepancy between the Goods purchased by the Customer and the Sales Agreement, to the extent specified in the Act on special terms of consumer sales.
6.2. Claims arising from the violation of the Customer’s rights guaranteed by law or the violation of Terms and Conditions described herein shall be sent to the e-mail address: firstname.lastname@example.org, and the goods shall be returned at the Seller’s expense to the following address: Katarzyna Czaplińska Interior Design, Kurowskiego 43, 05-080 Hornówek. Katarzyna Czaplińska Interior Design is obligated to consider any complaint within 14 days, and if it is not possible, to inform the Customer in that period about the date when the complaint will be considered. If there is no response from the Seller in the above period, it means that the Seller has found the complaint to be justified;
6.3. It is recommended that the Customer provides in the description of the complaint:
1. information and circumstances relating to the subject of the complaint, in particular the type and date of the occurrence of the defect
2. description of the way to bring the product into compliance with the Sales Agreement or a statement with a request to reduce the price or to withdraw from the Sales Agreement.
3. The contact details of the person who is making the complaint - this will facilitate and accelerate the consideration of the complaint by the Seller. The requirements listed in the previous sentence are only a recommendation and do not affect the effectiveness of the complaints which are lodged without the description of the complaint.
6.4. Katarzyna Czaplińska Interior Design is not the manufacturer of the goods. The manufacturer is liable for the sold Goods on the terms and for the period indicated in the warranty card.
7. Final Provisions.
7.1. The warranty and the right of withdrawal from the Agreement does not apply when the product is mechanically damaged. In order to preserve the warranty rights and the right of withdrawal from the Agreement, the Customer is obliged to check before accepting a package from a courier whether the packaging or the product has not been damaged in transit. If the packaging of the product or the product bear the markings of damage, the Customer must not accept the product and should complete in the presence of the courier the Shipping Damage Report and send the information to the address: email@example.com
7.2. The settlement of any disputes arising between Katarzyna Czaplińska Interior Design and the Customer who is a consumer within the meaning of Art. 221 of the Civil Code, is subjected to the courts competent in accordance with the relevant provisions of the Code of Civil Procedure.
7.3. Matters not regulated herein shall be governed by the Civil Code, the provisions of the Act on electronic services and other relevant provisions of the Polish law.
